These Terms and Conditions ("Terms") govern your access to and use of gomy.bio (the "Service"), operated by OrgBubble, a Delaware corporation, doing business as gomy.bio ("OrgBubble", "gomy.bio", "we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
gomy.bio provides a link-in-bio and creator tools platform, including but not limited to:
- URL shortening, branded short links, and custom domains;
- Customizable link-in-bio pages and QR code generation;
- The Gift Shop, a marketplace feature allowing sellers to offer digital and physical gifts or rewards to their audience, with payments processed via Stripe and Stripe Connect;
- An AI Copilot feature that uses third-party AI providers to help generate bio content, suggestions, and insights;
- Analytics, statistics, and related tools.
We may add, modify, or remove features of the Service at any time, with or without notice.
2. Eligibility and Accounts
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and use the Service. By registering, you represent that all information you provide is accurate and complete, and you agree to keep it up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@gomy.bio if you suspect unauthorized use of your account.
3. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third party's rights, including intellectual property, privacy, or publicity rights;
- Distribute malware, phishing links, or content designed to deceive or defraud others;
- Send spam or unsolicited bulk communications;
- Shorten, host, or link to content that is illegal, fraudulent, obscene, defamatory, or that promotes violence, hate, or discrimination;
- Attempt to gain unauthorized access to the Service, other accounts, or our systems;
- Interfere with or disrupt the integrity or performance of the Service.
We use automated and manual tools, including link and IP reputation checks and domain blocking, to detect and prevent abuse. We may suspend or terminate access to links or accounts that violate this policy, with or without prior notice.
4. Gift Shop, Payments, and Seller Terms
The Gift Shop allows registered sellers to list gifts or rewards for sale to their audience. The following additional terms apply to sellers using this feature:
- Payment processing. All payments are processed by Stripe. To receive payouts, sellers must connect a Stripe account via Stripe Connect and agree to the Stripe Connected Account Agreement. We do not store your full payment card or bank details.
- Platform commission. We retain a commission on each completed sale, at the rate disclosed in your seller dashboard at the time of listing. Stripe's own processing fees also apply and are separate from our commission.
- Seller responsibility. Sellers are solely responsible for the accuracy of their listings, for fulfilling any exclusive content or rewards promised to buyers, and for complying with applicable consumer protection, tax, and disclosure laws in their jurisdiction.
- Prohibited listings. Gifts or rewards may not involve illegal goods or services, counterfeit items, or content that violates Section 3 (Acceptable Use).
- Refunds and disputes. Refunds, chargebacks, and payment disputes are handled in accordance with Stripe's policies. We are not a party to the transaction between a seller and a buyer and are not responsible for fulfilling, refunding, or guaranteeing any gift or reward.
5. Content and Intellectual Property
You retain ownership of the content you upload or create using the Service (including bio pages, images, notes, and other reward content). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit that content solely as necessary to operate and provide the Service to you and your visitors.
The Service itself, including its design, features, and underlying software, is owned by OrgBubble and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, reverse-engineer, or create derivative works from the Service except as expressly permitted.
6. AI Copilot
The AI Copilot feature uses third-party artificial intelligence providers to generate suggestions, drafts, and insights based on inputs you provide. AI-generated content may be inaccurate, incomplete, or unsuitable for your purposes, and you are responsible for reviewing and editing any AI-generated content before publishing or relying on it. Do not submit sensitive personal information, payment details, or confidential information as input to the AI Copilot.
7. Third-Party Services and Links
The Service may integrate with or link to third-party services (including Stripe, AI providers, social platforms, and other tools). We are not responsible for the content, policies, or practices of third-party services, and your use of them is subject to their own terms and privacy policies.
8. Subscription Plans
Certain features of the Service require a paid subscription plan. Subscription fees are billed in advance on a recurring basis and are non-refundable except as required by law or as otherwise stated at the time of purchase. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. You may stop using the Service and delete your account at any time. Provisions of these Terms that by their nature should survive termination (including Sections 5, 6, 10, 11, and 12) will survive.
10. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORGBUBBLE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless OrgBubble, its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your Gift Shop listings, or your violation of these Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
